I have just visited your website and I have found that your FTP site is distributing private links to product that we offer to those who donate to the various charities that we support.

By doing this, you are actually hurting the several RailRoad restoration societies who do use this money to help maintain the equipment for future generations to enjoy.

If you are not the person who uploaded these links, I ask you to work with us and the authorities to discover who is responsible. I am also contacting your ISP to help in analyzing the FTP log file for the dates of 12/18/02 between 12:16pm and 12:19PM

I download these files and found some files I have right to host on my FTP according to the license, some not. Since my work is very busy. I have no time to check which one is. So I don't touch them.

Now I remove all of these links. But I will check these files and put these one which license no problems on my FTP later. BTW, that's a FTP not a website.

Don't ask me stop provide downloading with these files. Unless your announce you decide to change your software license type released before in your homepage. Even you doing that, I still doubt on this behavior legally. But I will stop provide downloading.

In the past, we had provided these files based on an honor system. While it would have been easy to circumvent, the large part of the community respected the intent of the downloads which was to help raise money for charitable organizations.

You apparently have disregard for this. Apparently, you do not care about how you are affecting these groups. Your only worry seems to be about your preceived "rights" with our work.

I also know about your quest in obtaining the ESE 2.x - you keep claiming that the ESE 2.x was freeware. It was never freeware - it was DONATIONWARE. We created the package to help raise money for the surviving families of the fireman who lost their lives during the World Trade Center Tragedy - the money went straight to Local 94 in New York City. Only the people who chose to ignore the readme and took advantage of our work considered it "free".

If this still does not make sense to you....if I can't appeal to your sense of decency, then I will change the license just for YOU.

the only reson i would donate is to get acsess to club ta. and besides why must we donate any way i mean its just a addon for a game? And also are you ta guys gonna relese that frisco 1522 as freeware? god i sure hope so i would be greatly disappointed if it wernt.

2. You can not only change these license only to me. Since it's a public license. You need change it for everyone who have it. Even if you only change it to me. You need make a statement publicly to let other people know I was exclude of this license. So they will not do something illegal for example send these file to me or download from my FTP.

3. There are no such things called DONATIONWARE as you said. If you bind donation behavior with get access. That mean these donation is still by you. Just like other people give money to you and you make donation. So it's a Commercial software. And I speak again you use a worng license type!

4. I don't care I can get ESE 2 or not. But you behavior let whole freeware world feel shame. I mean nothing you stop providing downloading. I have no question about that. Of course you have right!I mean you force other website stop provide a true freeware. I never hear such things since 1997 I connected to Internet. And I also mean you do such thing underground like saying "You'll have serious legal problems". And all of us know that's not true.

5. You are also disregard these freeware author's right which made they product depend on your "freeware". They read the license and think that can use as a base. But they are worng! They can not belive what they read! You need check your "freeware" license and add such things like not allow to make freeware reskin and alias!

And since you such saying, never call you software freeware anywhere later!

Ya, talk about that issue.
I've sent ESE2 to over 10 people who have requested me because the loco they downloaded from AVSIM doesn't work.
And, you know what's really sad? The author of that loco is blamed that his content is not free, not TA.
I will continue to send out ESE2 and other freewares if requested unless there is public announce of license change.
